Introduction and Acceptance

By accessing or using Areaview (including the website, mapping tools, forum, messaging, and reports), you agree to these Terms and our Privacy Policy. Areaview is an analytics and information platform. Nothing on Areaview is legal, tax, or investment advice.

Who Can Use Areaview

You must be at least 18 years old and able to form a binding contract. If you use Areaview on behalf of an organization, you confirm you have authority to bind that organization to these Terms.

Accounts and Security

Accounts are provided by Clerk for authentication. You are responsible for keeping your login secure and for all activity under your account. We may suspend or terminate accounts for violations of these Terms.

Subscriptions, Billing, and Credits

• Payments are handled by Stripe.
• Free tier: limited access to map and forum.
• Paid plans: more data fields, forum icon/tag, monthly report credits (500 for Investor, 10,000 for Professional).
• Credits: used to generate reports. Credits deduct at purchase time and appear in your balance.
• All credits (including those from subscriptions and purchases) roll over and expire 24 months after the date they are granted or purchased.
• Pricing and taxes may change. Current plan info is shown during checkout.
• Refunds are only provided for duplicate charges or clear billing errors. For all other refund questions, please contact support.

Reports and Data Outputs

Reports summarize many data points and may include maps, charts, and statistics. Reports are for informational purposes only and are not guaranteed accurate or complete.

• License: personal or internal business use. No resale or redistribution without written permission. Commercial redistribution is not allowed.

User Content: Forum and Messaging

• You may post in the forum and send messages.
• You grant Areaview a nonexclusive license to host, store, reproduce, and display your content for operating the service.
• No illegal content, harassment, doxxing, spam, or intellectual property violations.
• Moderation: we may remove content or restrict accounts that break the rules.
• Saved posts are private to you.
• Group messages: up to 8 participants.
• Notifications for likes and replies are part of the service.

Acceptable Use

• Do not scrape, harvest, or use bots to access the site or data without written permission.
• Do not try to break, overload, or bypass rate limits or security.
• Do not misrepresent data sources or remove attribution where required.
• API or automated access requires our approval and separate terms if offered.

Data Sources and Accuracy

Data may come from public sources, third parties, and internal modeling. Boundaries and labels may be approximate. Maps and layers are for context only. We may update, correct, or remove data at any time.

Third-Party Services

Authentication by Clerk, payments by Stripe, mapping by MapTiler/MapLibre/Leaflet, messaging by Ably, email marketing by Loop, and other providers may be used. Use of those services may be subject to their own terms and privacy policies.

No Financial, Legal, or Tax Advice

Areaview does not provide investment, legal, or tax advice. Users should verify information and consult qualified professionals.

Intellectual Property

Areaview owns the site, software, logos, and branding. You receive a limited license to use the site and services while you follow these Terms. Do not copy, modify, or create derivative works from our IP without permission.

Feedback

If you send ideas or suggestions, you allow us to use them without obligation or compensation.

Termination

• You can stop using Areaview at any time.
• We may suspend or terminate access for violations, risk, or legal reasons.
• On termination, your right to use the service ends, but sections that by nature should survive will continue.

Changes to the Service and to These Terms

• We may change features or these Terms.
• If we make material changes, we will provide reasonable notice. Continued use means you accept the changes.

Disclaimers and Limitation of Liability

• Service provided “as is” and “as available.”
• We do not promise uninterrupted or error-free operation.
• To the fullest extent allowed, Areaview is not liable for lost profits, lost data, or indirect damages.
• Our total liability is limited to the amount you paid in the prior three months.
• Some jurisdictions do not allow certain limits; if so, those limits apply only to the extent permitted.

Indemnification

You agree to indemnify Areaview against claims arising from your misuse of the service or violation of these Terms.

Governing Law and Dispute Resolution

• This agreement is governed by the laws of the State of Nevada, without regard to conflict of law principles. Venue for any dispute will be in Nevada.
• Arbitration clause: Any dispute will be resolved by binding arbitration on an individual basis. Class actions are waived. You may opt out within 30 days by emailing support.
• Small-claims court carve-out: Either party may bring a claim in small-claims court.

These Terms and the Privacy Policy are the entire agreement regarding the service and supersede prior agreements.
